1. Description of the Service

Der Die Oops is an educational mobile application designed to help users learn German grammatical articles (der, die, das). The App offers:

• Training Mode: A quiz-style practice mode where users select the correct article for German words.
• Learning Mode: A flashcard-based vocabulary study mode for reviewing words and their articles.
• Vocabulary Categories: Words organized into categories such as Family, Food, Home, Leisure, Nature, Services, and Travel.
• Proficiency Levels: Content organized by the Common European Framework of Reference (CEFR) levels A1 through C2.
• Multi-Language Support: Interface and translations available in English, Ukrainian, Polish, French, and Arabic.
• Progress Tracking: Local tracking of learning streaks, word mastery, and daily goals.
• Notifications: Optional learning reminders to help maintain consistency.

2. User Accounts

The App does not require you to create an account or provide login credentials. All user data, including your display name, learning preferences, and progress, is stored locally on your device.

Because there is no account system:

• Your data is device-specific. If you uninstall the App or switch devices, your learning progress will be lost.
• I cannot recover lost data. I do not maintain backups of your local data.
• Your display name is optional and is stored only on your device.

3. Free Tier and Limitations

The App is free to download and use with the following limitations:

• Energy System: Free users receive a limited number of energy units per day. Each training session consumes one energy unit. Energy resets daily. Additional energy can be earned by watching rewarded video ads.
• Advertisements: Free users will see ads (banner, interstitial, and rewarded video ads).
• Streak Freezes: Free users receive a limited number of streak freezes. A streak freeze protects your learning streak if you miss a day.

4. Premium Subscription ("Der Die Oops Pro")

4.1 Premium Benefits

Upgrading to Der Die Oops Pro grants the following benefits:

• No Advertisements: All ads are removed.
• Unlimited Energy: No daily limit on training sessions.
• Additional Streak Freezes: More streak freezes to protect your learning streak.

4.2 Pricing

Premium subscriptions are available at the following price points (prices may vary by region and are displayed in your local currency at the point of purchase):

• Monthly: EUR 1.99 per month
• Yearly: EUR 11.99 per year
• Lifetime: EUR 24.99 one-time purchase

Prices are subject to change. Current prices are always displayed in the App and on the respective app store listing.

4.3 Subscription Management

All subscriptions are processed and managed through the Apple App Store (for iOS) or Google Play Store (for Android).

• Monthly and Yearly Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
• Payment is charged to your App Store or Google Play account upon confirmation of purchase.
• Cancellation: You can cancel your subscription at any time through:
  • iOS: Settings > Apple ID > Subscriptions > Der Die Oops
  • Android: Google Play Store > Menu > Subscriptions > Der Die Oops
• Refunds: Refund requests must be directed to Apple or Google, as I do not process payments directly.
• Lifetime Purchase: The Lifetime plan is a one-time, non-recurring purchase that grants permanent access to all premium features.
• Restore Purchases: If you reinstall the App or switch devices within the same platform, you can restore your previous purchases through the App's settings.

4.4 Free Trials

If a free trial is offered, it will be clearly indicated at the time of subscription. At the end of the trial period, your subscription will automatically convert to a paid subscription unless canceled before the trial expires.

5. Intellectual Property

The App, including its design, code, content, graphics, icons, audio files, word databases, translations, and all other materials, is my intellectual property and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes, subject to these Terms.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse-engineer, decompile, or disassemble the App.
• Extract or scrape the word database, translations, or other content from the App.
• Use the App's content to create a competing product or service.
• Remove, alter, or obscure any copyright or proprietary notices in the App.

6. Prohibited Uses

You agree not to use the App for any purpose that is unlawful or prohibited by these Terms. Specifically, you may not:

• Attempt to interfere with or disrupt the App or its infrastructure.
• Use automated means (bots, scrapers, etc.) to interact with the App.
• Circumvent or attempt to circumvent any security or access control mechanisms.
• Submit false or malicious bug reports.
• Violate any applicable law or regulation while using the App.

7. Bug Reports

The App includes an optional bug reporting feature. By submitting a bug report, you agree that the information included in the report (as described in our Privacy Policy) may be used to diagnose and resolve technical issues. Bug report data is retained for 12 months and then deleted. Please do not include sensitive personal information (such as passwords or financial details) in your bug report.

8. Disclaimers

8.1 "As Is" Service

The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 Educational Content

The App is an educational tool designed to assist with learning German articles. I do not guarantee that use of the App will result in fluency, academic achievement, or any specific learning outcome. The content is provided for educational purposes and may contain occasional inaccuracies.

8.3 Availability

I do not guarantee that the App will be available at all times or free from interruptions, errors, or defects. I reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice.

8.4 Third-Party Services

The App relies on third-party services that are outside my direct control. I am not responsible for the availability, accuracy, or performance of these third-party services.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall I be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the App, regardless of the theory of liability.

In no event shall my total liability to you for all claims arising out of or related to the App exceed the amount you have paid in the twelve (12) months preceding the claim, or EUR 50.00, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, liability shall be limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Yurii Kuzela from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the App.

11. Termination

You may stop using the App at any time by uninstalling it from your device. Active subscriptions must be canceled separately through the Apple App Store or Google Play Store.

I reserve the right to restrict or terminate your access to the App at any time if I reasonably believe you have violated these Terms.

Upon termination, your right to use the App ceases. Sections 5, 8, 9, 10, and 12 survive termination.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall be resolved by the competent courts in Austria, unless otherwise required by the mandatory consumer protection laws of your jurisdiction.

13. Changes to These Terms

I reserve the right to modify these Terms at any time. When material changes are made, I will update the "Last updated" date at the top and may notify you through the App or website.

Your continued use of the App after the revised Terms take effect constitutes your acceptance of the changes.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Yurii Kuzela regarding your use of the App.
